Purpose

LEA seeks to comply with its obligations under the Privacy Act 1988, the Privacy Amendment (Enhancing Privacy Protection) Act 2012, and the Australian Privacy Principles.

This policy outlines how LEA uses and manages personal information provided to or collected by it.

Exclusion

Under the Privacy Act, the Australian Privacy Principles do not apply to employee records. As a result, this Privacy Policy does not apply to LEA’s treatment of an employee record where the treatment is directly related to a current or former employment relationship between LEA and the employee.

Employee Record

A record of personal information relating to the employment of an employee, including:

  • Engagement, training, discipline or resignation
  • Termination of employment
  • Terms and conditions
  • Personal and emergency contact details
  • Performance or conduct
  • Hours of employment
  • Salary or wages
  • Membership of professional or trade associations
  • Trade union membership
  • Leave entitlements (recreation, long service, sick, parental, etc.)
  • Taxation, banking or superannuation information

Individual

The person to whom personal information relates.

Personal Information

Australian Lutheran primary, secondary, and P-12 schools and colleges.

Information about an individual’s:

  • Racial or ethnic origin
  • Political opinions or associations
  • Religious beliefs or affiliations

  • Professional or trade association membership
  • Trade union membership
  • Sexual orientation or practices
  • Criminal record
  • Health or genetic information
  • Biometric information

that is also personal information, health information about an individual, genetic information about an individual that is not otherwise health information, biometric information that is to be used for the purposes of automated biometric verification or biometric identification or biometric templates.

Policy Statement

LEA seeks to comply with its obligations under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

LEA manages a large volume of personal information, mostly about staff of Australian Lutheran ECEs, schools, colleges, and regional offices. This information is provided to LEA to ensure a current national database is maintained appropriately.

This policy outlines how personal information is collected, used, stored, disclosed, and accessed.

1. Privacy Principles

LEA will:

  • Only collect personal information necessary for its functions or activities.
  • Only collect sensitive information with consent, where required by law, or as permitted under the Australian Privacy Principles.
  • Take reasonable steps to ensure individuals are aware that information is being collected.
  • Use fair and lawful methods to collect information.
  • Inform individuals of the intended use of the information.
  • Where practicable, collect personal information directly from the relevant Lutheran educational institution.
  • Ensure information is used and disclosed in accordance with the Australian Privacy Principles.
  • Take reasonable steps to ensure information is accurate, complete, and up to date.
  • Protect personal information from misuse, loss, unauthorised access, modification, or disclosure.
  • Destroy or permanently de-identify information when no longer needed.
  • Provide individuals access to their personal information upon request, subject to legal exceptions.
  • Give people the option of interacting anonymously or under a pseudonym where it is practicable or lawful for us to do so. It is normally not practicable for us to do so. If you would like to discuss information being made anonymous or under a pseudonym, please contact our Privacy Officer.
